By accessing or using Swingalytica, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Modifications

We may update these Terms at any time. Changes will be effective upon posting on our website. Continued use after updates constitutes acceptance. Material changes will be notified separately when feasible.

3. User Accounts

Some features require an account. You are responsible for maintaining account security and for all activities under your account. Notify us immediately of unauthorized use.

4. Prohibited Activities

You agree not to:

• Use the Service for unlawful purposes
• Attempt to bypass or interfere with security mechanisms
• Upload harmful, malicious, or illegal content
• Impersonate others or misrepresent affiliations
• Access or use the Service in violation of intellectual property rights

5. Intellectual Property

All content, software, and trademarks provided through Swingalytica are owned by RealGolf.Games UG (haftungsbeschränkt) or its licensors. You may not copy, distribute, modify, or create derivative works without express permission.

6. Subscription and Payments

Subscriptions are billed as described in the customer portal. Cancellations must follow the procedure in the portal. Refunds are subject to applicable German law.

7. Disclaimer of Warranties

Swingalytica is provided "as is". We make no warranties regarding accuracy, reliability, or availability, except as required by mandatory law.

8. Limitation of Liability

To the fullest extent permitted by law, RealGolf.Games UG (haftungsbeschränkt) shall not be liable for direct, indirect, incidental, or consequential damages arising from your use of the Service.

This does not limit liability for death, personal injury, fraud, or any other liability that cannot be excluded under German law (BGB).

9. Termination

We may suspend or terminate accounts for violation of these Terms. Upon termination, your access ends and stored data may be deleted according to our Privacy Policy.

10. Data Processing & GDPR

Personal data is processed according to the Privacy Policy and GDPR. Users may exercise rights to access, rectification, erasure, or restriction as provided by law. For AI training and analytics, anonymized data may be used. Complete deletion from AI models is only required if technically feasible.

11. Third-Party Services

The Service may interact with third-party providers (e.g., Supabase, MongoDB, Paddle). We are not responsible for their content, availability, or performance. Third-party terms apply.

12. Governing Law & Jurisdiction

These Terms are governed by German law. Any disputes fall under the exclusive jurisdiction of Bremen courts, Germany.

13. Severability

If any provision is invalid or unenforceable, the remaining provisions remain in effect.
